If she is saying the baby is his, he has the legal right to challenge her claim. If she is looking for him to support that child, then she has to agree to a DNA test. Simple as that. If he is not found to be the father, he is NOT legally liable for the baby. If she is not looking for him to support the baby, then the paternity test will not be as much of a priority. You can still get it done. Your fiance will need to go to court and request one on the grounds that it might be his and that she is saying it might be his and he wants parental rights (visitation, etc)if it is his child. Legally, if he even thinks he is the father, he has the right to at least get proof or disproof of her claim. I would advise you to seek out a lawyer specializing in Paternity/DNA/Family law.
