Need to Vent...(same As Teen Forum) Posted: 04-17-06 22:04pm
I hate insurance companies! My husband
was in an accident last week and the lady
that was at fault, her insurance is taking
us for a ride! They keep calling us to
get the police report for them and take
the car to them to make an
estimate....Which they know the car is not
in driving condition! They are stalling
and they say they aren't sure if they can
cover it, because according to the lady my
hubby had hit the car in front of him
before she hit my hubby. Which is .B.S!
Ugh. First off, the lady that hit my
hubby lied to the cop, and her insurance
company. It was a 3 car pile up, caused
by her. My hubby slowed for traffic as
did the guy in front of him, and the lady
behind my hubby was on the phone and
smacked right into the rear of him,
pushing him into the guy in front of him.
The back end is all messed up. The bumper
got pushed down to where it's hitting the
back tires and in front there is a deep
hole from the trailer hitch on the other
guys vehicle. The back is much worse than
the front, my hubby had his breaks on when
she hit him to begin with but stepped even
harder to try and avoid hitting the guy in
front of him. But anways, the lady got
the ticket. Not my hubby, or the other
guy. So I don't see how her insurance
won't pay. Any insurance people out there
that could shed some light on this?
Thanks for listening!

I'm not an "insurance person," but I have
been in a very similar situation. When I
was in high school, I was in the center of
a 3-car wreck. The car in front of me had
to slam on brakes because someone turned
at the last minute, so I had to slam on
brakes. I stopped (i still remember that
feeling of relief from stopping), but the
car behind me hit me and ran me into the
car in front.
The cops figured out who was at fault
really easily: they asked the guy driving
the first car how many times he got hit.
He said once, which proved I wasn't at
fault. (if I had hit him first, he would
have felt impact then and also when I got
hit by the car from behind.)
anyway, I can't possibly see how the
insurance company can not pay it... The
cops gave that lady the ticket, therefore
she was at fault and her insurance company
is responsible. Perhaps you can call your
own insurance company and speak to an
agent about what's going on. They might
be able to help better.
But if it persists, take her to court.
She got the ticket, so she has no case.
And I wouldn't drive the car
.A.N.Y.W.H.E.R.E!!! For all you know,
they could say you did something else to
it, ya know?

Thanks for the reply. I don't see how her
insurance isn't responsible to pay this,
bottom line she hit my hubby's car. I'm
not sure if this cop was smart enough to
ask the first guy how many times he was
hit. I sure hope so.
Also another way to prove she hit my hubby
before he hit the other guy is because of
the amount of damage done to the back.
Had he hit the other guy first there would
have been a lot more damage than there is
in front, especially since it was a jeep
cherokee. I think i'm mostly worked up
over nothing. Even tho this health forum
lied about this she is the only one that
got a ticket, and I know if the cop
thought my husband hit the guy in front of
him first, he would have also gotten a
ticket.
The other insurance company finally came
out today to estimate the damages and they
said an adjuster would be in touch with
me. We only drove the car home from where
it was. We probably should have towed it,
but it was so close to home that we
*tried* to lift the bumper up a bit so it
wasn't rubbing on the wheel. After that
it's been sitting in our driveway. My
husband says if they total the car he's
gonna syphon the gas out of it lol. He
just filled it the day before he got hit.
Figures. And we just sold our truck last
month. Just our luck. Also a few weeks
ago he got new mufflers put on the car,
which are now barely hanging on. That
health forum is gonna pay! >:)

Hehe. Get her, girl!
I really don't think you have anything to
worry about. Mostly because the ticket
has already been issued and blame has
already been placed in the eyes of the
law. The only hassle you'd probably get
out of it is if you had to take the
insurance company to court. It could be a
major pain in the butt. But if they have
any sense at all, they'll just pay it and
be done with it. It's not like it's
really their loss, anyway, all they have
to do is up her payment.
Anyway, good luck, and keep me posted!

Another really good thing to do is call
your own insurance company and ask them
what advice they can give you. Our house
was hit by a kid and his insurance was
fighting us saying it was snowy and what
not. My point was that my house didn't
run out in front of him, but that's
another story. Anyways we didn't get any
where with the guys insurance, so we
called our own insurance and they fought
that battle for us. We didn't have to do
anything, or say anything. Your
insurance ppl can atleast give you some
help on what to say and what to do and
what not to do.

Lmao, that's hilarious. "lost the
capacity to enjoy life" from being bumped
on their bumper? Heee heee. I guess
ppl will do anything for some money. It
wouldn't even cost that much to just fix
the damn scratch, let alone buy a new car.

Hey I just wanted to say that I work in
insureance. If you are having trouble
with the lady's insureance co. Call your
own ins co.. Your company will take care
of it and sue the other company for the
cost it took for them to process your
claim and get everything taken care of.
If you have a co-pay of like 500.00 or
like 1000.00 something like that they will
sue for it back and they will get that
back to you. I understand that you may
or may not have the money to pay for it
but that is one way to get your car taken
care of.
